§ 2-240. Purposes, functions and powers.

  • The public building commission is hereby created for the following purposes and shall be and is hereby authorized to exercise the following functions and powers, to wit:

    (a)

    To acquire a site or sites for and construct, reconstruct, equip and furnish a building or buildings or other facilities of a revenue-producing character, including parking facilities, or purchase or otherwise acquire such building or buildings or facilities, and such building or buildings or facilities shall be maintained and operated for the housing and accommodation of city offices, county courthouses, jails or correctional facilities, offices for school districts, or offices for state or federal agencies, or such other purposes as are commonly carried on in connection with such facilities.

    (b)

    To acquire land and facilities, including leasehold interest therein, adjacent to or near Kansas State University, and constructing, reconstructing, equipping and furnishing such facilities on such land and the leasing or subleasing of such land and facilities to any board of trustees of Kansas State University or to the official governing body of said university.

    (c)

    To rent all or any part of its buildings or other facilities to any federal, state or county governmental agency, or any municipal corporation, quasi municipal corporation, political subdivision or body politic, or agency thereof doing business, maintaining an office, or rendering a public service within the City of Manhattan or within Riley or Pottawatomie Counties. Further, to rent any space as may be needed by such governmental agencies for such service facilities as the public building commission may determine will primarily service the comfort and convenience of the occupants of its buildings or other facilities.

    (d)

    If the City of Manhattan, Kansas, is a tenant of any building or facility owned by the public building commission, the commission shall have the power to allow the city to sublease all or any portion of such building or facility to any other governmental agency or to any private entity. However, if the City of Manhattan, Kansas, chooses to lease all or any part of such building to a private entity, the governing body of the city shall determine that the portion so leased to a private entity is not needed for any public purpose of the city.

    (e)

    To issue revenue bonds of the public building commission to provide funds for the purposes set forth herein and to pay all costs and expenses incident thereto or to refund its outstanding bonds.

    (f)

    To establish and fix rates, rentals, fees and charges for the use of any and all buildings or space therein or other facilities owned and operated by the commission, sufficient at all times to pay maintenance and operation costs of such buildings or facilities, as well as the principle of an interest on all bonds issued by the commission when the same shall become due and payable, and to make all payments to any accounts created by any bond resolution.

    (g)

    To acquire the fee simple title to real property or a leasehold interest in real property, including easements and reversionary interests in the streets, alleys and other public places and personal property required for its purposes, by purchase, gift, devise or by exercise of the power of eminent domain of the state, and title thereto shall be taken in the corporate name of the commission.

    (h)

    To enter into written leases with tenants of its buildings or facilities under such terms and conditions as it shall deem appropriate, not inconsistent with the provisions of this division, the laws of the State of Kansas, and Charter Ordinance No. 26 of the City of Manhattan, Kansas.

    (i)

    To convey title to real estate it shall hold title to and sell, assign, transfer, trade any of its interest in personal property.

    (j)

    To do all things necessary and incidental to the purpose of constructing or acquiring or enlarging, furnishing and equipping, and operating and maintaining buildings to be made available for use pursuant to this division, together with all powers afforded it by the provisions of K.S.A. 12-1757 et seq., and Charter Ordinance No. 26.
