§ 23-90. Acts specifically prohibited.

  • (a)

    Fires and fireworks. Fires may not be built or allowed anywhere in park, recreation or open space areas, except in stoves, fireplaces or designated areas provided for that purpose. It shall be unlawful for anyone to possess or to discharge fireworks of any type in park, recreation and open space areas without written consent from the director of parks and recreation.

    (b)

    Animals. It shall be unlawful for owners of domesticated animals to permit such animals within Lud Fiser Youth Sports Complex in CiCo Park or Twin Oaks Softball Complex in Anneberg Park during a scheduled activity. At Sunset Zoological Park, it shall be unlawful to permit domesticated animals including dogs inside the zoo grounds at any time.

    (c)

    Merchandising, advertising and signs. No person shall in parks, recreation areas or open space areas:

    (1)

    Offer for sale any article or thing, nor station or place any stand, cart or vehicle for the transportation, sale or display of any such article or thing, except under the authority of the city manager by application or permit;

    (2)

    Announce, advertise or call to the public attention in any way any article or service for sale or hire, except under the following conditions:

    a.

    Temporary advertising in connection with specific events or activities conducted within the parks may be permitted under such terms and circumstances as approved by the city manager pursuant to a policy adopted by the governing body;

    b.

    Advertising on uniforms of participants in events or activities is permitted under such terms and circumstances as approved by the city manager;

    c.

    Advertising in connection with sales taking place within the park under authority of the city manager is permitted under such terms and circumstances as approved by the city manager;

    d.

    Advertising that exists as of the date of this section, which is affixed to a specific improvement or structure and which has been so affixed with the consent of the city, shall be permitted to remain for the useful life of the improvement or structure or for the period set forth in any agreement with the city entered into prior to the date of this section, whichever period of time is shorter;

    e.

    Signs which recognize a donor may be permitted in connection with gifts or donations for specific improvements, when approved by the city manager pursuant to a policy adopted by the governing body;

    f.

    All regulations in this article concerning signs shall supersede all other ordinances or regulations of the city concerning signs, and in the event of a conflict between this article and other ordinances or regulations as to signs, this article shall control;

    (3)

    Post, paste, fasten, paint, write, draw, tack or affix any placard, bill, notice, sign advertisement or any inscription upon any structure, tree, stone, fence or enclosure within any park or recreation area or on any public lands or highways or roads adjacent to any park, recreation and open space area, except for those approved and permitted by the city manager's office pursuant to a policy adopted by the governing body.

    (d)

    Solicitations. Solicitations for donations by groups or individuals are prohibited within park, recreation and open space areas, without written permission from the director of parks and recreation.

    (e)

    Personal conduct. It shall be unlawful for any person in any park, recreation or open space area to:

    (1)

    Endanger the safety of any person or property by any conduct or act;

    (2)

    Violate any rule for the use of the park or park facility made or approved by the city, provided the rule is in a written form available for public inspection at the city clerk's office;

    (3)

    Prevent any person from using any park or any of its facilities or to interfere with such use in compliance with this article and the rules applicable to such use.
