§ 22-5. Smoking prohibited.

  • (a)

    It shall be unlawful for any person to smoke or carry a lighted cigar, cigarette or pipe within any building owned by the city.

    (b)

    For the purpose of this section, the term "building" shall mean any covered, enclosed structure built for support, shelter or enclosure of persons, animals, chattels or moveable property of any kind, and which is permanently affixed to land, and which is heated, cooled or ventilated by mechanical means. In addition, the term "building" shall include all structures, either temporary or permanent, from which food or drink is dispensed.

    (c)

    The prohibition contained within this section shall not apply to that portion of buildings owned by the city and leased to another party, or parties.

    (d)

    Buildings in which smoking is prohibited under the terms of this section shall be posted with a sign, in a conspicuous place, clearly stating that smoking is prohibited by city ordinance.
