§ 13-55. Permits for fireworks displays.

  • (a)

    It shall be unlawful to provide a fireworks display, as defined in the most recently adopted version of the international fire code, for the public, or for organized groups, without a valid permit issued by the city.

    (b)

    An applicant must submit the application on the form provided by the city at least 30 days prior to the date of the desired fireworks display. The application shall be complete and shall be accompanied by a nonrefundable $250.00 application fee. The permit shall be approved or denied by the governing body. The permit shall only be issued if the fire chief, or his designee, has determined that the location, nature and other factors relating to the fireworks display will not create an undue hazard or risk of harm or damage to persons or property.

    (c)

    The fireworks display shall only occur at the date and time specified on the permit, including an alternate date in case of inclement weather.

    (d)

    The permit shall be automatically revoked and void in the following circumstances:

    (1)

    The applicant fails to furnish a certificate of commercial general liability insurance in a minimum amount of $2,000,000.00 written by an insurance carrier licensed to do business in the state, at least three business days prior to the date of the fireworks display;

    (2)

    If the insurance policy is cancelled at any time prior to the fireworks display;

    (3)

    If the permit holder does not make all fireworks, equipment, installation and display site available for inspection by the city at least two hours prior to the fireworks display start time; or

    (4)

    If, at the inspection described in subsection (c), the fireworks, equipment, installation and display site do not comply with the most recently adopted version of the fire code, the permit requirements, or this section, and such noncompliance cannot be remedied, to the satisfaction of the fire chief or his designee, prior to the fireworks display.
