§ 7-33. Definitions.

  • For the purpose of this article the following definitions shall apply:

    Air operations area means any portion of airport property within the perimeter of an established fence or boundary.

    Airport means Manhattan Regional Airport that is solely owned and operated by the city.

    Airport director means the person in charge of the airport for the city.

    Aeronautical activity means any activity occurring at the airport which involves, makes possible, or is required for the operation of aircraft, or which contributes to or is required for the safety of such operations. These activities include charter operations, pilot training, aircraft rental, crop dusting, aircraft sales and service, sale of aviation petroleum products, repair and maintenance of aircraft and sale of aircraft parts.

    Certification specifications means FAA approved guidelines for operation of the airport in accordance with FAR Part 139.

    Commercial activity means any aeronautical activity or operation occurring at the airport which is designed for producing revenue from charges for services or commodities but does not include nonprofit organizations.

    Defueling means to remove fuel from an aircraft.

    Emergency plan means the plan approved by the FAA for the airport's management of emergency situations on airport property a copy of which is on file with the city clerk.

    FAA means Federal Aviation Administration or its successor.

    FAR means Federal Air Regulation as promulgated by the FAA.

    Hazardous waste means the definitions of hazardous substances, hazardous material, toxic substance, regulated substance or solid waste as defined by federal, state, or local laws.

    His/her representative, when referring to the airport director, means the person delegated such authority by the airport director and shall include officers and representatives of the county police department and the department of fire services in the enforcement of any portion of this article involving public and/or aviation safety, security and order.

    Minimum standards means the qualifications which are established by the city as the minimum requirements to be met as a condition for the right to conduct a commercial activity on airport property.

    Operator means any person having charge, care, management or control of any commercial activity or any person who owns a business that engages in any commercial activity.

    Security area means a specific portion of airport property defined by the airport security plan.

    Security plan means the plan approved by the FAA providing security measures to protect lives and property from terrorist acts a copy of which is on file with the city clerk.

    Service animal means any guide dog, signal dog, or other animal individually trained to do work or perform tasks for the benefit of an individual with a disability, including, but not limited to, guiding individuals with impaired vision, alerting individuals with impaired hearing to intruders or sounds, providing minimal protection or rescue work, pulling a wheelchair, or fetching dropped items.

    Transient aircraft means aircraft not based at the airport.

    Uniform Fire Code means the current version of the UFC as set forth in section 13-16 of this Code as amended by section 13-18 of this Code.
