§ 6-52. Disposition of animals.

  • Animals delivered to the animal shelter, which have been found to be running at large within the City of Manhattan, or Riley County, and which are not claimed by their owner, keeper or harborer within a period of five full days in which the shelter is open to the public, shall become the property of the City of Manhattan, Kansas. Dogs delivered to the animal shelter pursuant to section 6-27 shall become the property of the city if the owner, keeper or harborer fails to redeem such animal within three days after it has been determined that such animal shows no evidence of rabies. Animals delivered to the animal shelter pursuant to an agreement with another governmental agency, and which are not claimed by their owner, keeper or harborer, within that period of time established by the agreement, or if no such period is established, within a period of five full days in which the shelter is open to the public, shall become the property of the City of Manhattan. Once an animal becomes the property of the city, either under the operation of this section or by a written release from the owner pursuant to section 6-51, the city may dispose of the animal either by adoption or by euthanasia.
