§ 34-39. Criteria

    (a)

    An owner's license and accompanying vehicle identification certificates shall only be issued or renewed by the city clerk if the applicant submits a complete application, including the fee(s), and the following conditions have been met:

    (1)

    The applicant has secured and maintains in full force and effect with an insurance company licensed to do business in Kansas a commercial general liability insurance policy covering liability arising from premises/operations, independent contractors, personal/advertising, and contractual liability, with minimum limits of $500,000.00 for each occurrence and $500,000.00 general aggregate. Such insurance shall contain all of the conditions required by the laws of the state and shall carry a uniform endorsement for actual notice to the city of any changes thereon; such policy and endorsement thereon shall further provide that it cannot be canceled until 30 days' written notice shall have been filed with the city clerk. The city reserves the right to require complete, certified copies of all required insurance policies including endorsements affecting the required coverage. The types and limits of insurance shown are to be considered as minimum amounts of insurance and in no way limits the liability of the licensee.

    (2)

    The applicant's taxicabs or livery vehicles meet the vehicle standards set out in section 34-38.

    (3)

    If the applicant has previously been licensed to operate a taxicab business, livery vehicle business, or another motor vehicle business that carries passengers for hire, the applicant's license was never revoked or suspended.

    (b)

    The applicant has paid the fee for a license under this division, as prescribed in section 19-44.
