§ 34-16. Definitions.

  • The following definitions shall apply in the interpretation and enforcement of this chapter:

    (1)

    Taxicab shall mean a motor vehicle designed for carrying 15 persons or less, which transports persons for hire, with driver furnished, and is solicited to the general public; provided, that the following vehicles shall not be considered to be taxicabs:

    (a)

    Vehicles owned by undertakers and used exclusively for funeral and ambulance service;

    (b)

    Any vehicle operated by an agency that receives funding from the Kansas Department of Transportation or the Federal Transit Administration to provide transit services to the general public, when those services include the picking up, transporting, or delivering of a passenger or passengers for hire;

    (c)

    Any vehicle defined as a livery vehicle in section 34-16(2).

    (2)

    Livery vehicle shall mean a motor vehicle designed for carrying fifteen persons or less, which transports persons for hire, at a fixed charge, with driver furnished, and is solicited to the general public. Provided that, a taxicab and the motor vehicles listed in subsections 34-16(1)(a) and 34-16(1)(b) shall not be considered to be livery vehicles.

    (3)

    Operate a taxicab or operate a livery vehicle shall mean and include the picking up, transporting or delivering a fare, when that fare originates within the jurisdiction of the City of Manhattan, Kansas, and shall not include passing through or delivering a fare to this jurisdiction when the fare originates elsewhere; neither shall it include delivering a fare that originates outside this jurisdiction to a location within the jurisdiction and then waiting for the fare and returning that fare outside the jurisdiction.

    (4)

    Fixed charge shall mean a single monetary amount assessed for the entirety of the service provided by the livery vehicle, which shall be determined and communicated to the passenger in advance of the commencement of such service by the provision of a written statement or receipt.

    (5)

    Cruising shall mean a method of soliciting passengers for hire by operation of any taxicab along a street or other public way for the purpose of obtaining or picking up pedestrians in the area.
