§ 32-186. Drainage easements—Purpose and restrictions on use.

  • (a)

    This section and section 32-187 shall govern all drainage easements dedicated, purchased or otherwise granted to, or acquired by, the City of Manhattan in writing.

    (b)

    No person shall construct, maintain, or allow any natural or non-natural structures or vegetative barriers that fill up or obstruct any drainage easement. Such natural or non-natural structures or vegetative barriers include but are not limited to trees, shrubbery, berms, fences, structures, walls and personality of all types.

    (c)

    A violation of any provision of this section is a misdemeanor offense to which the penalty of section 1-7 of the Code of Ordinances of the City of Manhattan, Kansas applies. Each day any violation of this section continues shall constitute a separate offense. Any person found guilty of violating this section shall moreover be liable for all damages, including restitution, that may accrue to any person or persons by such act or acts.
