§ 32-117. Monthly sewer charges.

  • (a)

    Users of services rendered by the POTW shall be charged a monthly sewer charge consisting of a sewer usage charge and a sewer service charge for each connection by which they are served.

    (b)

    Except for all facilities owned by Kansas State University, any new or existing structure located outside the city limits shall pay an additional surcharge equal to one and one-half times the rates set forth in subsection (c) and (d) below. All facilities owned by Kansas State University shall pay the monthly sewer charges for facilities inside the city as set forth in subsections (c) and (d) below regardless of whether the facilities are located inside or outside of the city limits.

    (c)

    Sewer usage charges shall be assessed for the purposes of recovering the variable costs of operating the POTW based upon the volume of water a customer uses as determined in section 32-118 below. The volume of water shall be measure in units equal to 100 cubic feet (C cf). The following monthly rates for sewer used shall be as follows:

    (d)

    Sewer service charges shall be charged per connection, per monthly billing period, and shall be assessed to all customers who have service availability at any time during a billing period as shown below. A customer is deemed to have service available if the private water service system, at the customer's residence or business, has been connected to the city's water distribution system and at any time during a billing period. The sewer service charges are to be applied regardless of whether or not any water volume passed from the city to private water systems during a billing period. Sewer service connections deemed inactive by the director of public works shall not be assessed sewer service charges. Sewer service charges shall consist of a minimum charge and a meter-based capacity surcharge.

    Minimum charges shall be assessed for the purposes of recovering fixed costs incurred by the city for operating the POTW, without regard to quantity of customer use. The minimum charge per each connection shall be as follows:

    (2)

    Capacity surcharges shall be assessed for the purposes of recovering capacity costs incurred by the city for operating the POTW, and shall be based on the water meter size and the customer's capacity to demand water from the water system and discharge wastewater to the POTW. The capacity surcharge per each meter shall be as follows:

    b.

    For customers that utilize a compound meter or fire meter, which consist of a combined two-meter system for the purpose of accurate metering of both high- and low-volume water demands, the larger of the two meters shall be used to determine the monthly capacity surcharge.

    c.

    For a one or two-family residential dwelling structure connected to the city water system that require a fire protection sprinkler system, if such sprinkler system requires a larger meter size to provide adequate fire protection, the fire chief, director of public works, or other duly designated representative of the city shall have the authority to determine the appropriate equivalent meter size to assess the meter-based monthly capacity surcharge to better reflect the standard residential meter size that would otherwise be necessary to provide domestic service to the structure.

    (e)

    Whenever the city provides sewer service to a wholesale customer located outside of the city limits pursuant to a written contract authorized by the city commission, the rates applicable to the user identified in that contract shall be the rates set forth within the contract, even if such rates are inconsistent with the provisions of this section.

    (f)

    Any institution, business or industry having a sewer connection, directly or indirectly, with the POTW and discharging wastewater therein with strengths in excess of 300 mg/L biochemical oxygen demand (BOD) and 350 mg/L total suspended solids (TSS) to the POTW shall, as they be hereinafter determined from time to time by the director, become subject to a surcharge. The surcharge which is a charge in addition to the metered use charge, shall be computed in accordance with the following surcharge formula:

    S = V × 0.00075 × 8.34 [B$ (BOD - 300) + T$ (TSS - 350)]

    Where:

    S = Surcharge in dollars

    V = Sewage volume in hundred cubic feet

    0.00075 = Conversion factor for hundred cubic feet to million gallons

    8.34 = Pounds per gallon of water

    B$ = Biochemical oxygen demand (BOD) unit charge in dollars per pound

    BOD = Biochemical oxygen demand in parts per million by weight or milligrams per liter (mg/L)

    300 = Allowable BOD strength under normal volume charges in parts per million by weight or milligrams per liter (mg/L)

    T$ = Total suspended solids (TSS) unit charge in dollars per pound

    TSS = Total suspended solids strength index in parts per million by weight or milligrams per liter (mg/L)

    350 = Allowable TSS strength under normal volume charges in parts per million by weight or milligrams per liter (mg/L)

    The unit charge for BOD and TSS are hereby established as follows:

    (g)

    In accordance with section 32-222, the cost of wastewater discharge permits for significant industrial users (SIUs) are hereby established as follows:

    (h)

    All liquid waste haulers are required to obtain an annual liquid waste discharging permit before any discharge of liquid waste to the POTW. The duration of the permit shall be January 1 to December 31. Furthermore, liquid waste haulers are required to pay a discharge fee based on the volume of liquid waste in gallons for each discharge. The cost of liquid waste permit and discharge fees are hereby established as follows:

    (i)

    In addition to the monthly sewer charges set forth in subsections (c) and (d), above, any property located within the city and also within the growth area, as that term is defined within the interlocal agreement (the "agreement") between the City of Manhattan and the Board of Pottawatomie County Commissioners acting as the Governing Body of the Blue Township Sewer Benefit District (the "district"), dated the 12th day of June, 2007 and connected to the district's sewer system, shall be assessed additional monthly sewer charges. The additional monthly sewer charges shall be the same as the sum the city is required to pay to the district, pursuant to Article IX(d)(3) of the agreement, and shall be paid at the same time as the other monthly sewer charges set forth within this section.
