§ 31-70. "Purple zone" parking permits for city parking lots in the C-4 zoning district.

  • (a)

    Any person leasing or owning residential real estate within the C-4 zoning district, as defined in the City of Manhattan Zoning Regulations, is eligible to apply for one or more resident parking permits. Each resident parking permit allows and shall be used only for the parking of the vehicle identified in the permit overnight between the hours of 5:00 p.m. and 8:00 a.m. in any parking lot owned and operated by the City of Manhattan, Kansas located in the C-4 zoning district even if it is otherwise unlawful to continuously park vehicles overnight between the hours of 5:00 p.m. and 8:00 a.m. in any such parking lot.

    (b)

    Applications for resident parking permits under this section shall be submitted to the city clerk's office or his/her designee on a form provided by the city clerk or his/her designee and shall be accompanied by a fee of $5.00 per permit and proof of the ownership of or the lease agreement for real estate within the C-4 zoning district.

    (c)

    The granting of all permits under this section depends upon available parking lot space. Each resident parking permit issued under this section shall be issued for a specific vehicle. Each resident parking permit shall expire on December 31 of the year for which it is issued, but it shall expire earlier than December 31 when the user of the vehicle identified in the residential parking permit no longer resides at, or owns, the property for which the permit is issued. All permits issued prior to January 1, 2010 shall expire on December 31, 2009, except for 2010 permits issued in advance.

    (d)

    Any person who is eligible to obtain a resident parking permit under the terms of this section may also obtain up to two guest parking permits depending on available parking lot space. A guest parking permit shall be requested on an application form provided by the city clerk or his/her designee, and such form shall be accompanied by a $5.00 fee per permit. Any guest parking permit granted under the terms of this section allows and shall be used only for the parking of any one vehicle by temporary bona fide guests of the property for which the permit is issued overnight between the hours of 5:00 p.m. and 8:00 a.m. in any parking lot owned and operated by the City of Manhattan, Kansas, located in the C-4 zoning district even if it is otherwise unlawful to continuously park vehicles overnight between the hours of 5:00 p.m. and 8:00 a.m. in any such parking lot. Each guest permit shall expire on December 31 of the year for which it is issued, but it shall expire earlier than December 31 when the person who obtained the permit no longer resides at, or owns, the property for which the permit is issued. All guest permits issued prior to January 1, 2010, shall expire on December 31, 2009, except for 2010 permits issued in advance.

    (e)

    Each permit granted pursuant to this section shall be in a form designed by the city clerk or his/her designee and shall be prominently displayed on the vehicle parked as required by the city clerk or his/her designee.

    (f)

    It shall be unlawful for any person to continue to use a permit after its validity has expired. It shall further be unlawful for any person to fraudulently obtain or use a permit or to allow another person to fraudulently obtain or use a permit.

    (g)

    Any person who violates the provisions of this section shall, upon conviction thereof, be fined not less than $15.00 nor more than $500.00.
