§ 30-140. Definitions.

  • Dumpster shall mean and include a bin, receptacle or container for the collection and storage of refuse, trash, garbage, solid waste, construction materials, and similar items and which is then hoisted onto a specially equipped truck to be removed and emptied of its contents at a dumpsite by a city-licensed refuse collector.

    Dumpster owner shall be the person who owns or controls the dumpster. If the dumpster owner is an entity, then any officer, partner, member, or other person responsible for the dumpster may be considered the dumpster owner.

    No practical alternative shall mean that the parcel that is served by the dumpster does not have adequate space to accommodate the dumpster, and that the use of such dumpster is necessary for a temporary activity occurring upon such parcel.

    "No practical alternative" shall not include circumstances of mere inconvenience or protection of grass or landscaping. In the event of a dispute about whether no practical alternative exists, the opinion of the city engineer shall prevail.
