§ 27-16. Definitions.

  • The following words and phrases, when used in this article, shall have the meanings respectively ascribed to them:

    Agents and employees shall mean all persons employed by a merchant guard or merchant patrol, in the conduct of his business, except stenographic and clerical employees whose duties are confined entirely to stenographic and clerical duties in the business office of the merchant guard or merchant patrol or other employees not directly engaged in providing protection or preserving the peace.

    Merchant guard or merchant patrol shall mean any person who conducts or is engaged in the business of providing protection or preserving the peace of the property of another for a fee.

    Property shall mean either personal or real property, and shall include property used for commercial, residential or industrial purposes.

    Providing protection and preserving the peace shall mean any service designed and intended to prevent the injury or damage to, or commission of a crime upon, the property of another, and shall include the routine surveillance of such property for that purpose.
