Kansas State University is hereby granted the right to construct, maintain, and operate
a cable television system in, through, and along the public rights-of-way of the City
of Manhattan, Kansas. Such right shall be for the sole purpose of supplying cable
television service to facilities owned and operated by Kansas State University. The
phrase "cable television service" shall exclude other telecommunication services including,
but not limited to, telephone and open video systems. Notwithstanding the fact that
this franchise is related to the providing of cable television service, the city hereby
declares that Kansas State University is not a "cable grantee" as that term is used
in the Communications Act of 1934 and the Telecommunications Act of 1966, and that
neither of such acts are applicable to the services provided under this article.
